Anyone familiar with purchasing property in the UK will understand the
processes that are in place to safeguard the purchaser, however these
services are not considered standard practice in the Spanish property
market. Many people looking for property in Spain are not aware of the
potential downfalls of investing in a foreign country. It is all too easy
to get carried away and make decisions that could be potentially disastrous.
Search and Survey investigates the three main areas where it is vital
that you have accurate information before making any commitment:
• We search the widest range of property available to help you
in selecting your property in an organised and considered way.
• Our Legal services and local searches provide security beyond
anything normally available in Spain.
• Our architectural department provides certified structural surveys
to highlight any defects and also provides independent valuations.
• In the case of a new building or off plan project we carry out
a thorough search on the financial status of the company promoting the
development.
Not withstanding the above, the main point to stress is you should NEVER
SIGN ANYTHING until you have had it checked by your lawyer. And NEVER
accept legal advice from the estate agent who is selling you the property
or a lawyer acting for him.
Typically Spanish lawyers restrict their activities to a fairly minimum
service i.e. checking the legal status of the property, checking contracts
and preparing documents for the transfer at the notary. This is does not
by any means cover the minefield of Spanish bureaucracy, such as pending
fines, tax implications or future planning developments.
Lawyers charges vary but they are usually based upon the value of the
property being purchased. Typically a basic service would cost 1.5% of
the property value with a minimum charge of 2,000€.
Our charge for a Full Service to ensure you know everything there is to
know before you commit is 3,300€ We require 500€ provision of
funds and the balance on completion.
